The FIA yesterday announced that the team's chanlenge to Ralf's penalty last weekend will go before the International Court of Appeal in Paris on Tuesday 3 May.

Ralf Schumacher was handed a 25 second penalty by the stewards after allegedly 'blocking' Nick Heidfeld's FW27 during the final pit stops at San Marino. This allowed Ralf to gain 8th position and sit tight until the chequred flag.

Nick was promoted to eigth position and Ralf was pushed back to 11th behind Webber and rookie Liuzzi.

Toyota is extremely unhappy with the penalty stating the regulations are 'extremely vague' and that in the past 'similar events have gone unpunished.'

Of course, the Jenson-BAR case will be heard one day later.
