Leeds agree to Private Arbitration deal

Leeds have agreed, under protest, to the Football Leagues arbitration offer, regarding the 15 points that were deducted by the FL. The club wanted it to be held in the open, but have now agreed to keep the deal private. Leeds wanted arbitration at the beginning of the season, but, as seems to have happened all year, the League left it to the last possible moment.
Further details are not yet available, but it needs to happen sooner rather that later...

Bates has moaned all season long he wants a public hearing and now he's agreed to this "private" arbitration meeting. Why ???
Seems to me the FL were bricking themselves to start with by offering an arbitration meeting as they would have to justify themselves in a High Court meeting, but now Bates has "shitout" by agreeing to it.
I dont like the possible outcome and still fear our -15 will be in place at the end of it and Bates will have wasted a lot of effort, money and hot air on this

think the fact that Bates has agreed is positive - the fact Bates has 'given' a little may mean there is a reason behind it - ie he has reason to belive that arbitration would work????

We shouldnt worry about how or what is done, as long as its ASAP.....then maybe an answer can be arranged without anyone losing face and we get what KB thinks is the right descision.
Maybe the golden share will make an appearence as well to save face and everyone kiss and make up i think we should get 10 points back.........but there you are im just a romantic old fool

I think a lot of the time in law, you have to accept reasonable offers by the other side to find means of settling disputes without going to court, which should be a last resort. I don't imagine we had any reasonable grounds to refuse their offer.

If it went to High Court it wouldnt be done and sorted before end of season - we want it sorted before then so this is the only way.
Secondly in order to get the arbitration done we have to agree to 'private' but if we win then expect Bates to publish the reasons in the open - having said this given the set-up its quite clear that both sides are trying to convince one person that being the unbiased person not nominated by either side.
Think you will find they will settle on a reduced penalty!

I just think as batfastards says, there needs to be compromise and had Bates refused and took it to Court, the judge would have every right to catergorise bates as being unhelpful.
Arbitration rules in the League are usually held in private so the FL are not being unreasonable in expecting this to be the same (in the eyes of the court).

Hope they are on a no win = very little fee contract. Otherwise the longer a lawyer spins something out - even with no chance of winning - the more they get paid. Shysters the lot of them.

we will now get something out of this. dont forget bates accepted UNDER DURESS this means he can still go to high court over this euro law if he is not sattisfied. I think we will get 10 back. mick

Think we may all be pleasantly surprised and see 10 points returned to ER!
FL can sort of wash their face as in future total penalty would be 15 points (10 for admin and 5 for exiting without a CVA).

I'm with BB. Luton and Bournemouth are unlikely to leave admin with a CVA! So I think the FL are finally accepting penalising clubs 25points (10 in to admin and 15 out) is too punitive.
One question are both parties bound by the results of the arbitration???

They agree to comply with the outcome but there is nothing to stop them mounting legal bid if they lose..
..But the court would not look favorably on someone that has lost at Arbitration and then taken it to court without 'exception circumstances' such as new evidence or clear evidence the arbitration was bias or something.
Don't forget a High court judge sits on the panel - so going to court after would be saying to the court that you disagree with something a judge has already ruled on.
Arbitration is less formal than a court and quicker - but the judgment is generally the same.

I know understand why KB has been making statements along the line that the biggest punishment for us was an inability to sign players. He is obviously starting from a point that we wants 15 points reinstated and a cash settlement for compensation. Hopefully with a result that is the 15 points are reinstated we will drop call for compensation.
That would lead us 6 points clear of Doncaster with them having a game in hand.
Hopefully it will be "All Hail Ken Bates". I don't think I can cope with anouther year in Division 3.

I hope it is resolved sooner rather than later, even if it does mean Leeds getting 15 points back. At least all of your rivals will know where they stand. I'm inclined to agree with Fids, I think it will be all or nothing. Am I right in thinking that when Spurs were docked 12 points in the 90s, they got them all back?
